PLAINTIFF'S SUPREME COURT CLAIM: Claim 3084/2008. Filed 4 April, 2008, against the Defendant, Julianne Heidi Hottes, in respect of

  • The Plaintiff's asserted equitable interest in the house and land located at 46 DiCaprio Circuit, Bridgeman Downs, Brisbane, Queensland, Australia, allegedly retained by the Defendant.
  • Antiques, jewellery, and chattels owned by the Plaintiff and allegedly retained by the Defendant.

In respect of the real property at 46 DiCaprio Circuit, the Plaintiff's claim asserted a resulting trust and constructive trust in favour of the Plaintiff, and alleged unjust enrichment by the Defendant. The defence asserted gift/ early inheritance and estoppel.

TRIAL: Heard before Justice D. Mullins, 17 - 20 October, 2011. (Originally scheduled for hearing 25 - 26 May, 2010 and 3 - 4 February, 2011.)

JUDGEMENT: Issued 12 March, 2012.
